Welcome to KANZ (“we”, “us”, “our”). KANZ operates this website and online store, including all related information, content, features, tools, products, and services (the “Services”) to provide you with a curated shopping experience. KANZ is powered by Shopify, which enables us to provide the Services.
These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when you use the Services.
Please read these Terms carefully. They include important information about your legal rights, including warranty disclaimers and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, do not use the Services.
SECTION 1 — ACCESS AND ACCOUNT
By using the Services, you represent that you are at least the age of majority in your state or province of residence. If you permit minor dependents to use the Services on devices you own, purchase, or manage, you are responsible for their activity.
To use the Services (including purchasing products), you may be asked to provide certain information, such as your email address and billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, complete, and that you have the right to provide it.
You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 — OUR PRODUCTS
We make reasonable efforts to display product details accurately. However, colors and appearance may vary depending on device type, screen settings, and lighting.
Unless expressly stated by KANZ, we do not guarantee that the appearance, feel, or quality of products will meet your expectations or appear exactly as displayed on your screen.
All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit quantities offered to any person, geographic region, or jurisdiction on a case-by-case basis.
SECTION 2A — MATERIALS, CARE, AND SENSITIVITIES (JEWELRY)
Many jewelry finishes, including plating and enamel, may be affected by normal wear and exposure to water, sweat, perfumes, lotions, cosmetics, cleaning chemicals, abrasion, or improper storage. Care guidance provided by KANZ is intended to help preserve your item.
Skin sensitivities vary. If you experience irritation, discontinue wear immediately. Our products are not intended to diagnose, treat, cure, or prevent any medical condition.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. KANZ reserves the right to accept or decline your order at its discretion, including for suspected fraud, inventory issues, or other operational reasons. Your order is not accepted until KANZ confirms acceptance and we successfully process payment.
Please review your order carefully before submitting. Orders may be canceled only before fulfillment begins. Once fulfillment begins, orders cannot be canceled. Made-to-order or customized items cannot be canceled once processing begins (typically within 24 hours after purchase).
If we do not accept, make a change to, or cancel an order, we will attempt to notify you using the email or other information provided at checkout.
Your purchases are subject to return or exchange solely in accordance with our Return & Refund Policy.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale.
SECTION 4 — PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and will be shown in your order confirmation.
Unless expressly stated, posted prices do not include taxes, shipping, or handling.
You agree to provide current, complete, and accurate purchase and account information for all purchases made. You agree to promptly update your account and other information (including your email address) so that we can complete your transactions and contact you as needed.
You represent and warrant that: (i) the payment information you provide is true, correct, and complete; (ii) you are authorized to use the payment method provided; and (iii) you will pay charges incurred at the posted prices, including shipping and applicable taxes.
SECTION 4A — CURRENCY
All prices are shown in USD unless otherwise stated.
SECTION 5 — SHIPPING AND DELIVERY
Shipping timelines are estimates and are not guaranteed. We are not liable for delays caused by carriers, weather, peak seasons, or events outside our control.
You are responsible for providing a correct and deliverable shipping address. If an order is returned due to an incorrect or incomplete address, refusal, or failure to receive the package, additional shipping charges may apply to reship.
Title to products transfers when the order ships. Risk of loss transfers upon confirmed delivery to the shipping address provided at checkout.
If tracking shows “delivered” but you have not received the package, you must contact us within 7 days of the delivery scan so we can assist with a carrier trace or claim process. We may request supporting documentation.
SECTION 6 — INTELLECTUAL PROPERTY
Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, and the design, selection, and arrangement thereof, are owned by KANZ, its affiliates, or licensors and are protected by U.S. and foreign intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent.
KANZ names, logos, product and service names, designs, and slogans are trademarks of KANZ. Shopify’s name, logo, and related marks are trademarks of Shopify. All other names and logos are trademarks of their respective owners.
SECTION 7 — OPTIONAL TOOLS
We may provide access to third-party tools that we do not control. You acknowledge and agree that we provide access to such tools “as is” and “as available” without warranties, representations, or conditions of any kind and without endorsement. Any use of optional tools is at your own risk.
SECTION 8 — THIRD-PARTY LINKS
The Services may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of third-party sites. If you leave the Services to access third-party websites, you do so at your own risk.
SECTION 9 — RELATIONSHIP WITH SHOPIFY

KANZ is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with KANZ. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and KANZ, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with KANZ.
SECTION 10 — PRIVACY POLICY
All personal information collected through the Services is subject to our Privacy Policy. Because our store is hosted by Shopify, Shopify also collects and processes information related to your access and use of the Services to provide and improve the Services.
SECTION 11 — FEEDBACK
If you submit ideas, suggestions, feedback, reviews, proposals, plans, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including commercial use.
You represent and warrant that you own or have all necessary rights to all Feedback and that your Feedback will comply with these Terms.
We may, but have no obligation to, monitor, edit, or remove Feedback that we determine in our sole discretion violates these Terms or any law.
SECTION 12 — ERRORS, INACCURACIES, AND OMISSIONS
Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate at any time, including after you submit an order.
SECTION 13 — PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not use the Services to: violate laws; infringe intellectual property; harass, abuse, or harm others; transmit false information; send spam; upload malware; scrape/crawl the site without permission; interfere with security features; impersonate others; or engage in behavior that harms KANZ, Shopify, or users.
We reserve the right to suspend or terminate access to the Services at any time if we determine you have violated any part of these Terms.
SECTION 14 — TERMINATION
We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice. You will remain liable for all amounts due up to and including the date of termination.
The following sections will survive termination: Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive.
SECTION 15 — DISCLAIMER OF WARRANTIES
The Services and all products offered through the Services are provided “as is” and “as available” unless expressly stated otherwise by KANZ. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, durability, title, and non-infringement.
Some jurisdictions do not allow limitations on implied warranties, so some of the above may not apply to you.
SECTION 16 — LIMITATION OF LIABILITY
To the fullest extent permitted by law, in no case shall KANZ, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, or licensors, or Shopify and its affiliates, be liable for any indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, loss of data, or similar damages, arising from your use of the Services or products purchased through the Services.
In all cases, to the fullest extent permitted by law, KANZ’s total liability shall not exceed the amount paid by you to KANZ for the product(s) giving rise to the claim.
SECTION 17 — INDEMNIFICATION
You agree to indemnify, defend, and hold harmless KANZ, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from losses, damages, liabilities, and reasonable attorneys’ fees arising out of your breach of these Terms, your violation of law, or your misuse of the Services.
SECTION 18 — SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, the remaining provisions will remain valid and enforceable to the fullest extent permitted by law.
SECTION 19 — WAIVER; ENTIRE AGREEMENT
The failure of KANZ to exercise or enforce any right or provision of these Terms shall not constitute a waiver. These Terms and any policies referenced constitute the entire agreement between you and KANZ regarding the Services and supersede prior or contemporaneous communications.
SECTION 20 — ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms without restriction.
SECTION 21 — GOVERNING LAW AND VENUE
These Terms and any dispute arising from them shall be governed by the laws of the State of New Jersey, without regard to conflict of laws principles. You and KANZ consent to exclusive venue and jurisdiction in the state and federal courts located in Morris County, New Jersey.
SECTION 22 — HEADINGS
Headings are included for convenience only and do not affect interpretation.
SECTION 23 — CHANGES TO TERMS
We reserve the right to update, change, or replace any part of these Terms by posting updates on our website. Changes are effective when posted unless a different effective date is stated. Your continued use of the Services after changes become effective constitutes acceptance.
